I will post two options for you, I have NOT TRY THEM, as I do not get this error, so make sure to BACKUP custom and save folders. I am not even sure this will correct your problem.

    http://forum.citiesxl.com/viewtopic.php?f=12&t=6196&start=30

    OPTION A:

Getting D3D device error on first time launch, follow these instructions to solve:

    1. Open nVidia Control Panel
    2. Select "Change resolution"
    3. Select 800 x 600 from the list, IF it does NOT exist then create a custom resolution with these parameters, 800 pixel width, 600 pixel height.
    4. Apply the 800x600 resolution, sorry for any icon mess on your desktop :)
    5. Launch the game, press ESC to skip the intro video and change the game resolution using the game menu (example: 1920x1080)
    6. Exit the game
    7. Using nVidia's control panel, switch your desktop resolution to its native (normal) resolution

The game will work fine from now on using a decent resolution. Have fun :)

OPTION B: (you may need a fresh install after doing so...)

Reset the settings of Cities XL 2012:

    1. Open Computer then Local disk (C: drive).
    2. Open Users folder.
    3. Open your username folder.
    4. Open AppData folder (*)
    5. Open Local folder.
    6. Open Focus Home Interactive folder.
    7. Delete Cities XL 2012 folder.

(*) The AppData folder is an hidden folder by default. To view this folder, click Organize from the top left then Folder and search options.
Click the View tab and check 'Show hidden files, folders and drives' under 'Hidden files and folders' in the 'Advanced Settings' window.
    Click the OK button.

Before you do all that, perhaps you could post a log file, so we can rule out other things? Found in the "log" folder in Appdata/local/FHI/CXL

I have narrowed down the problem to the terrain leveler mod, I was leveling down 1 step to get the desired level for building underpass highway, then I was leveling back up to zero height, something is happening when I level back up to zero height from negative height, I have 2 cities that load fine and then after a few minutes crash to desktop, The leveler mod works fine once, but leveling more than once in a given area is causing the crash, Thanks for the tips, I really appreciate it,
    DHS,

Are you talking about Nicko's terraforming plazas?

yes, I believe that is the one, It is a great mod, I think that I did find some limitations with it is all, I will be a little more careful with using it in the future,

Interesting, I've never heard of problems with it before, but I'm glad to hear you've narrowed it down. Best of luck!
